When a Buyer or Seller Cannot Close
Closing disputes often involve a series of documents: the original contract, conditions, waivers, extensions, notices and correspondence between the parties. The precise wording and sequence of events can be important to understanding each party’s obligations.
We review what happened, the parties’ readiness to complete, the financial consequences and the available evidence. Where appropriate, we assist with extension negotiations, settlement terms, demands, claims and defences. Do not assume that a deposit determines the full extent of either party’s potential liability.
Ownership and Co-Owner Disagreements
Disputes can arise when co-owners disagree about selling a property, paying expenses or dividing proceeds. Contributions, title records, written agreements and the history of the arrangement may all be relevant.
We help identify the issues requiring resolution and assess negotiation or court proceedings, including partition and sale where appropriate. The available remedies depend on the ownership interests, evidence and applicable law; a sale or a particular division of proceeds is not automatic in every case.

Bring the signed agreement and all amendments, deposit records, closing documents, relevant title information, correspondence and a concise timeline. Records of losses, expenses, financing and efforts to resolve the problem can also assist the assessment.

Can you help before a disputed closing date?
Yes, subject to availability and conflicts. Provide the agreement, amendments and all relevant deadlines promptly so we can assess whether immediate advice or action is needed.
Will the deposit automatically be returned if a transaction fails?
Not necessarily. Entitlement to a deposit depends on the contract, the circumstances of the failed transaction and applicable law. Obtain advice before signing a release or agreeing to its distribution.
Do you handle routine closings as well?
Yes. Our firm also handles residential and commercial real estate transactions. A contested transaction requires a separate assessment of the dispute and the appropriate retainer.
