Recovering Unpaid Loans and Business Debts

We assist with unpaid personal and business loans, invoices, contractual debts and disputed guarantees. The first step is to identify the correct parties, the basis of the obligation, when payment became due and the evidence supporting the balance claimed. A written demand or negotiated payment arrangement may be appropriate before court proceedings, but urgent circumstances or limitation concerns can change that approach.

We assess the appropriate court and procedure based on the claim, the amount and the relief sought. Our work can include preparing claims and defences, organizing disclosure, addressing motions and representing clients at settlement conferences and trials.

Defending a Debt Claim

Being sued does not mean the amount claimed is correct. Relevant issues may include payments not credited, disputed performance, the interpretation of the agreement, interest calculations or a defence to liability. Bring the claim and proof of when and how it was served so we can identify the response deadline. Do not ignore court documents while discussing settlement.

A Judgment Is Not the Same as Payment

Obtaining a judgment does not guarantee recovery. Enforcement options depend on the debtor’s income, assets, competing claims and other legal restrictions. We consider proportionality and recoverability alongside the merits of the lawsuit. Where appropriate, we assist with garnishment, examinations and seizure and sale procedures.

Provide the signed agreement, invoices, payment records, relevant correspondence, guarantees and any existing court documents. Include a short timeline, the amount you say is outstanding and information about attempted repayments or settlement.
