Separation Agreements: Clear Terms for the Next Stage

Property Rights Depend on Your Relationship and Circumstances
Married spouses and common-law partners do not have identical property rights in Ontario. Married spouses may have an equalization claim under the Family Law Act. That framework involves the calculation and comparison of net family property rather than simply dividing every asset in half.
Common-law partners do not automatically share in that statutory equalization regime. Ownership, agreements and potential trust or other equitable claims may require examination. We review the relevant facts before advising on a property claim or proposed settlement.

A proposed transfer or buyout may also require lender approval, refinancing or tax advice. A separation agreement between partners does not itself release either person from an obligation to a lender.
Before You Sign an Agreement
Each party should obtain independent legal advice about the proposed terms. Provide complete financial records and allow time to understand the agreement’s effect. Ontario law requires domestic contracts to be in writing, signed and witnessed; meeting those formalities does not resolve every possible enforceability issue.

Can you review an agreement prepared by someone else?
Yes, subject to conflicts and availability. We review the proposed terms and supporting disclosure, explain their effect and identify concerns or further information needed.
Can property issues be resolved without litigation?
Often the parties can negotiate a resolution, but that depends on disclosure, their positions and the issues involved. If agreement is not possible, we can assess available court proceedings.
Does living together create the same property rights as marriage?
No. The legal framework differs. Ownership and potential claims must be assessed on the particular facts rather than assuming that a common-law partner has a right to half of the other person’s assets.
