Pension Division in Ontario Divorce: Valuation and Equalization

By Hashmi Law Group ·

For many couples, a pension is the single most valuable asset accumulated during a marriage, sometimes even exceeding the equity in the family home. Because of its high value, pension equalization is frequently one of the most heavily contested issues in a divorce. Understanding your rights and obligations regarding pension division is critical to securing your retirement.

Pensions as Matrimonial Property

In Ontario, pensions are explicitly recognized as property. When a married couple separates, the value of the pension accumulated strictly between the date of marriage and the date of separation must be included in the calculation of the Net Family Property (NFP) under the Family Law Act.

Valuation: The Family Law Value (FLV)

Under the Pension Benefits Act, R.S.O. 1990, c. P.8, spouses cannot simply guess or independently estimate the value of a defined benefit pension. The pension plan administrator must calculate the "Family Law Value" (FLV). This requires submitting specialized provincial forms to the administrator, who will then provide a binding statement of the pension's value for the precise period of the marriage.

Methods of Division and Judicial Scrutiny

Once the FLV is determined, how the non-member spouse receives their share can be negotiated. There are generally two methods:

Immediate Transfer: Up to 50% of the FLV can be transferred directly from the pension plan into the non-member spouse’s locked-in retirement vehicle (such as a LIRA).

Asset Offset (Buyout): The pension member keeps their pension completely intact but gives up another asset of equal value—such as their share of the matrimonial home—to satisfy the equalization payment.

Tax treatment and contingent tax liabilities should be considered carefully when comparing a pension transfer with an asset offset. The appropriate adjustment depends on the pension, the settlement method and the circumstances of the spouses.

Pension division is a highly technical area of family law that requires precision. A mistake here can cost you thousands of dollars in your retirement years. Leverage the experience of the Hashmi Law Group to ensure your financial future is accurately calculated and fiercely protected.
